For any questions regarding this privacy policy or the processing of personal data, users of the website www.floydfungi.ch (“website”) may contact hello[at]floydfungi[dot]ch or the above address.
1. Introduction
We are very pleased about your interest in our website. The protection of your personal data is very important to us. Therefore, we inform you below in detail about how we process your data.
The owner, operator, and controller of the website www.floydfungi.ch is SARRIA Juan Carlos Floyd, Rue de la Tournelle 29, 1350 Orbe, Switzerland, sole proprietor of “FloydFungi” – Sarria J.C. Floyd (hereinafter “we”, “our” or “FloydFungi”). By accessing and using the website, you as a user (“user”) declare your consent to this privacy policy in its entirety, in addition to all other laws or regulations applicable to the website and the Internet. We reserve the right to update this policy from time to time. If this occurs, we will publish any changes on this website. Furthermore, we will not limit the rights granted to you in this privacy policy without your express consent. If we make significant adjustments, we will personally inform our customers and contacts.
Access to our website is subject to general, indiscriminate, reasonless and suspicion-independent mass surveillance by security authorities in Switzerland, the EU, the United States, and other countries.
We have no influence over the processing of personal data by police, security authorities, or intelligence services.
Before using the website, we advise you to read this privacy policy carefully. If you do not agree with this privacy policy, you are not authorized to access the website and must leave it immediately.
The current version of FloydFungi’s privacy policy can be consulted at any time at www.floydfungi.ch/protection-des-donnees. You may also save or download it as a PDF. Older versions are archived and available upon request.
2. Applicable Law
The website is subject to Swiss data protection law: the Federal Act on Data Protection (FADP), as well as, where applicable, foreign data protection legislation, in particular the European Union’s General Data Protection Regulation (GDPR). The latter recognizes that adequate data protection is guaranteed in Switzerland.
3. Purpose of the Privacy Policy
We treat all personal data (“personal data”) confidentially. Personal data is any information relating to an identified or identifiable natural person. A natural person is considered identifiable if they can be identified, directly or indirectly, for example by reference to information that can be inferred from circumstances or context (identification number, location data, specific aspects of physical, physiological, genetic, mental, economic, cultural, or social identity). Identification may be possible from a single piece of information (telephone number, house number, social security number, fingerprints, etc.) or by combining several pieces of information (address, date of birth, marital status, etc.). The purely theoretical possibility that a person could be identified is not sufficient to assume identifiability.
This privacy policy explains how we process personal data and, in particular, which user data is processed and for what purposes. It also describes how collected personal data can be verified, corrected, or deleted.
This privacy policy does not extend to external links leading to third-party offers and websites. These are outside our control; therefore, the data protection provisions of the respective provider apply and must be consulted.
4. What Personal Data Do We Store and Process?
This website is designed to collect as little user data as possible.
The following information may be recorded:
-
Information you provide by completing the contact form.
-
Notes and records of consultations and briefings.
-
Content you provide when placing an order, such as photographs, texts, videos.
-
Records of correspondence when you contact us.
-
Information relating to your visits to this website, including “traffic” data (e.g., IP address, host name of the computer, browser information, referring site domain name), location data, weblogs, and other data necessary for our own or other purposes.
-
Your IP address as well as the time and date of your visit to our website.
We also reserve the right to include graphics and web links in our newsletters that may record, per recipient, whether users have opened the newsletter and which web links they have clicked. This allows us to know if and how newsletters are used, and to ensure and improve their quality.
We may also ask you to participate in surveys for research purposes. Participation in such surveys is always voluntary.
The aforementioned information does not contain data that allows us to identify you personally. It is used for analysis and the purposes defined below.
Legally, we are permitted to record and collect user data based on Article 6(1)(a), (b), and (f) of the GDPR. Information security justifies our interest in this data.

It is necessary to exercise, assert, or defend legal rights and there is no reason to believe that the user has an overriding and legitimate interest in keeping their data confidential.
In this context, personal data may also be transferred abroad (i.e., to countries without equivalent data protection legislation). Any transfer of data to countries not recognized by the Swiss Federal Data Protection and Information Commissioner (FDPIC) as having adequate data protection is carried out on the basis of specific contractual agreements, such as the standard contract for outsourcing data processing abroad defined by the FDPIC. We ensure that personal data is transmitted, processed, and secured in accordance with applicable law and the prescribed level of data protection and security.
We never disclose personal data for purposes other than those mentioned here. Personal data is never sold, rented, or otherwise marketed to third parties unless the user has expressly consented.
If we have published a user’s personal data and are required to delete it, we will inform all recipients of such data that the user has requested the deletion of all links to and copies of that personal data. To this end, we take appropriate technical and organizational measures, taking into account available technologies and implementation costs.
At the user’s request, we are obliged to inform them of the recipient of their personal data.
6. Where Do We Store Your Data?
The data we collect about you may be transmitted and stored at locations in Switzerland (server location).
All data you provide to us is stored on a secure server. We retain this data only as long as necessary to fulfill the purpose for which it was collected. This includes, in particular, compliance with legal and contractual obligations, keeping accurate operational records, resolving legal disputes, and enforcing our rights in connection with the use of the website.
We use technical and organizational security measures to prevent, for example, misuse, loss, theft, destruction, falsification, manipulation, and alteration of personal data and information. All information we collect is stored on secure servers protected by password and firewall. These measures correspond to the current state of the art and are adapted to the type and scope of data processing, as well as to potential risks.
Our web hosting provider’s server (INFOMANIAK SA) records and stores certain technical data, such as the user’s IP address and device operating system, access time, browser type, and browser request, including the source of the request. This is necessary for technical reasons so that we can make the website available to the user. Through technical and organizational measures, the web hosting provider protects this data against unauthorized access and must not pass it on to third parties.
7. Data Protection and Security Measures
Unfortunately, data transmission over the Internet is never completely secure. We therefore cannot guarantee the security of data you transmit to this site. However, we do everything possible to protect your personal data. The transmission of all data is at your own risk. Once we have received your data, we protect it using strict security procedures and features to prevent unauthorized access.
Your personal data sent to our server via the Internet is transmitted as securely as possible using SSL/TLS (Secure Sockets Layer/Transport Layer Security) encryption. SSL-protected domains are indicated by a padlock symbol in your browser.
8. Copyright
The content of our website is subject to copyright. Processing, distribution, reproduction, and any use outside the limits of copyright law require our written permission. Copies or downloads of the website are only permitted for private use, not for commercial use. If content on the website was not created by us, the copyrights of third parties are respected. If users notice a copyright infringement, please inform us. The necessary contact details are provided below or in the website’s legal notice.
9. Cookies
We use cookies on our website to offer a safer, better, and faster user experience. We use the following cookies on our website:
-
Session cookies: These are used to operate our services and to recognize if a user has already visited the platform in the past. These cookies are automatically deleted after leaving the platform.
-
Persistent cookies: We use these to better understand how users use the website and to offer them advertising tailored to their needs.
-
Security cookies: These are used for security reasons.
All information automatically recorded by cookies is used exclusively for statistical analysis. It is not linked to personal data voluntarily provided by the user.
Cookies are small files that are automatically stored on the user’s computer when visiting a website. They record information such as IP addresses, domain names, browser types, and other statistical data about platform use. Cookies allow us to analyze user behavior and thus optimize the website. They ensure the error-free provision of the website and cannot contain viruses or cause damage to the user’s computer.
Generally, browsers allow users to prevent the installation of cookies, generate a warning before installation, and delete cookies. All browsers contain specific instructions for this. If the user blocks cookies, it is possible that some website functions may no longer be available.
10. Web Analytics Services
To evaluate website usage, we use web analytics services from third-party providers, to whom users’ personal data may also be transmitted in the context of using these services. We also use (social) plug-ins from various providers (Google Analytics and WooCommerce) on the website. This may involve data collection by the respective providers. Users can prevent data processing by web analytics services or (social) plug-ins by using the opt-out mechanisms available from the respective network operator. The available opt-out mechanisms are described in the privacy policies of the respective network operators. Opting out may prevent the user from using all functions of the website.
Google Analytics is a web analytics service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google uses “cookies,” text files that are stored on the user’s computer and allow analysis of website usage. The information generated by the cookie about usage (including the user’s IP address) is transmitted to and stored on a Google server in the United States. Due to this setting, Google shortens IP addresses collected in EU member states or in other states party to the Agreement on the European Economic Area before storage. Google will use this information to evaluate website usage, compile reports on user activity, and provide other services related to website and Internet use. Google may also transfer this information to third parties where required by law or where such third parties process the information on Google’s behalf. Google will not associate the user’s IP address with any other data held by Google. Users can prevent the installation of cookies by adjusting their browser software accordingly. However, please note that in this case all functions of the website may not be fully usable. By using the website, users consent to the processing of data about them by Google in the manner and for the purposes set out above.
If the user does not wish to allow Google Analytics, they can install the browser add-on (https://tools.google.com/dlpage/gaoptout) to disable Google Analytics. Further information on Google’s privacy practices or on data protection in connection with Google Analytics can be found on the Google Privacy & Terms website at https://policies.google.com/privacy?hl=en or on the Google Analytics Help website at https://support.google.com/analytics/answer/6004245?hl=en.
We use Google Analytics on the platform with Universal Analytics features. This allows us to analyze website activity across devices (e.g., when access occurs first via a laptop and then via a smartphone). This is made possible by assigning a pseudonymous user ID to a user, for example when the user registers for a customer account or logs in. No personal data is transmitted to Google. The additional features of Universal Analytics do not limit the data protection measures mentioned above.
The data collected via Google Analytics is retained as long as necessary for website analysis. After a maximum period of 50 months, the data is automatically deleted.
WooCommerce is a free plug-in for WordPress that adds online store functionality to the content management system and was developed by WooThemes, based in San Francisco, California, USA. When users visit the website, their browser establishes a direct connection to the servers of the aforementioned providers and the corresponding button is loaded from there. The information that the corresponding website has been visited is then transmitted to the relevant provider. If the user is a registered user of the relevant service, the provider may also associate the page visit with the corresponding profile and, in certain circumstances, collect further data. To ensure the protection of personal data, we also use the open-source program Shariff. This means that user data can only be processed by the plug-in provider when the user has clicked on a plug-in. After clicking on a plug-in, data may be processed by the plug-in provider without further notification.
We regularly publish and share content and offers on these social networks. The nature, scope, and purposes of data processing on social networks are primarily determined by the network operators. Further information on data collection and processing by the respective operators can be found in the privacy policies of the respective providers, which can be accessed at http://www.woocommerce.com.
11. Newsletter
We offer our customers and users a newsletter service. The user receives information on the topics covered in the newsletter and other notices by subscribing to the newsletter service. When using the newsletter, we also collect data relating to the user’s device and access. To subscribe, the user must register with their email address, first name, and last name, and confirm in an email we send that they wish to subscribe to the newsletter service (“double opt-in process”). If this registration confirmation does not occur within two (2) days, we delete the email address and the registration does not take place. Only after confirmation by the user is the email address used for this purpose permanently stored with us, until the user unsubscribes from the newsletter or we delete it. The user can unsubscribe from the newsletter at any time. An unsubscribe link is included in every newsletter email.
Our newsletter does not contain visible or hidden trackers, third-party advertising, or links to third-party websites not directly related to the newsletter content.
The email address is collected for sending the newsletter. Additional personal data is used to prevent misuse of the services or the email address used. By submitting the newsletter registration, the user consents to the processing of data in connection with the sending of the newsletter. The user agrees that a newsletter will be sent regularly to the specified email address and that usage behavior will be statistically evaluated to optimize the newsletter. We are authorized to transmit user data to third parties for the technical processing of the newsletter.
12. Your Rights
All users of our website, as well as other persons, have the right to request free information about whether their personal data is stored and processed by us, and if so, which data. Any person has the right to obtain the following information about their personal data:
-
origin;
-
transmission;
-
purpose of collection and use;
-
intended duration of storage;
-
type of processing.
In addition, every user has the right:

to revoke consent previously given;
-
to object to the processing of their personal data.
All persons whose data we process also have the right to lodge a complaint with the competent data protection supervisory authority. In Switzerland, this is the Federal Data Protection and Information Commissioner (FDPIC).
13. Changes to the Privacy Policy
We reserve the right to adapt, supplement, and amend this privacy policy at any time in accordance with legal requirements. We therefore recommend that users reread this privacy policy from time to time. The current version is always available on our website. The current privacy policy replaces all previous versions and is binding on website users with immediate effect.
Please note that users are always responsible for keeping their personal data up to date and for providing their current contact details or any changes.
For any questions regarding the privacy policy and the processing of personal data, users may contact hello[at]floydfungi[dot]ch at any time.
14. Final Provisions
In the event of any discrepancy between the French version and other language versions of our privacy policy, the terms contained in the French version shall prevail.
In case of contradiction or dispute, only the French version of our Privacy Policy is legally binding.
